Serving Manitoba since 1974

These Terms of Service explain what you can expect from us, and what we ask in return, whenever you book a service, request a quote, use our website, or become an MVP Member. We have written this in plain language so nothing is hidden or buried in legal jargon. If you have any questions at all, please call us at 204-818-8330 or email info@brownsplumbing.ca before work begins.

Acceptance of These Terms

By contacting Brown’s Plumbing & Heating to request a service, booking an appointment, signing a quote or proposal, using our website, or enrolling in our MVP Membership, you agree to be bound by these Terms of Service. These terms apply to all customers in Winnipeg, Steinbach, Morris, and every other area we serve across Manitoba.

If you are booking on behalf of a business, property management company, or any other organization, you confirm that you have the authority to agree to these terms on their behalf.

Scope of Services

Brown’s Plumbing & Heating provides residential and light commercial plumbing, heating, cooling, and HVAC services, including but not limited to:

  • Furnace and boiler repair, maintenance, and installation
  • Air conditioning repair, maintenance, and installation
  • Heat pump installation and service
  • Ductless HVAC systems
  • Plumbing repairs, installations, drain cleaning, and leak detection
  • Water heater service and replacement
  • Gas line inspection and connection
  • Water filtration and water quality treatment
  • Indoor air quality solutions
  • Radon testing (Winnipeg and Steinbach)
  • Sheet metal fabrication

Work performed is limited to what is described in the agreed-upon quote or work order. Any additional tasks discovered on-site that were not part of the original scope will be communicated to you before we proceed, and will require your approval.

Estimates & Proposals

All written quotes and proposals are valid for 30 days from the date they are issued, unless otherwise stated. After 30 days, pricing may change due to fluctuations in parts costs, equipment availability, or labour rates.

Estimates provided over the phone or via our online instant estimate tool are approximate figures based on the information available at the time. A final price is confirmed once a technician has assessed the work in person.

Scheduling & Access to Your Property

Our regular service hours are Monday through Friday, 8:00 AM to 5:00 PM. Emergency service availability may vary. MVP Members receive priority scheduling and are never charged overtime fees for emergency repairs.

To do our work properly, we ask that you or an authorized adult (18 years or older) be present at the property during the service visit, or make clear arrangements for access. If our technician arrives and cannot gain access to the property, a trip charge may apply.

Please ensure that the area around your equipment (furnace, water heater, air conditioner, pipes, etc.) is reasonably accessible and clear of belongings before our technician arrives. We are not responsible for damage to items left in the work area.

We schedule appointments as accurately as possible, but delays can happen due to traffic, longer-than-expected prior jobs, or weather. We will contact you if we are running significantly behind.

Payment Terms

Payment for completed work is due in full upon completion of the service, unless a financing arrangement through Enercare or Financeit has been set up in advance. We accept major credit cards, debit, and other payment methods confirmed at the time of booking.

For larger installation projects, we may require a deposit at the time of scheduling. This deposit amount will be clearly stated in your proposal.

If payment is not received in accordance with your agreement, Brown’s Plumbing & Heating reserves the right to charge a service fee of 1.5% per month on the outstanding balance. We may also pursue collection through appropriate legal means, with all associated costs, including reasonable legal fees, being the responsibility of the customer.

Cancellations & Changes

You have the right to cancel a signed service agreement within 72 hours of signing, provided no work has begun and no materials have been ordered. After 72 hours, cancellation may result in forfeiture of any deposit paid.

If materials or equipment have already been ordered or delivered, you may be responsible for any restocking fees or the cost of non-returnable items, even if work has not yet started. We will always be upfront with you about what those costs would be before you make a decision.

To cancel or reschedule an appointment, please call us at least 24 hours in advance so we can offer that slot to another customer. Repeat no-shows may affect our ability to offer priority scheduling in the future.

Refunds are not issued for work already performed or for services the customer has confirmed as completed.

Warranties on Our Work

We stand behind our workmanship. Brown’s Plumbing & Heating provides a 1-year labour warranty on repairs and installations unless a different period is specified in writing on your agreement.

Our labour warranty covers defects that are a direct result of how we performed the work. If something we installed or repaired fails due to our workmanship within the warranty period, we will return to fix it at no additional labour cost to you.

The warranty does not cover:

  • Normal wear and tear or end-of-life equipment failure
  • Damage caused by neglect, misuse, or lack of basic maintenance (such as not changing furnace filters)
  • Issues arising from pre-existing conditions in your home that were not part of our scope of work
  • Damage resulting from power surges, flooding, fire, or other external events
  • Work on equipment that has been modified or serviced by someone other than Brown’s Plumbing & Heating after our visit
  • Existing ductwork, wiring, copper lines, or drainage systems that were not part of the agreed installation

Manufacturer Warranties on Equipment

When we install new heating, cooling, or plumbing equipment, the equipment itself comes with a manufacturer’s parts warranty. The length and terms of that warranty vary by brand and product. We will provide you with the relevant warranty documentation at the time of installation.

Manufacturer warranties are held directly between you and the equipment manufacturer. Brown’s Plumbing & Heating is not responsible for honouring a manufacturer’s parts warranty, though we will do our best to assist you in filing a warranty claim if needed.

To keep your manufacturer warranty valid, most brands require annual professional maintenance. Our MVP Membership is a great way to stay on top of this automatically. Please review your equipment’s warranty documentation carefully, as some warranties can be voided by missed maintenance or the use of unauthorized parts.

MVP Membership Terms

Our MVP Membership is an annual plan that gives you priority service, a 15% discount on repairs, and a comprehensive 42-point tune-up covering your heating, cooling, and plumbing systems. Here is what you need to know:

  • The membership begins on the date of purchase (or date of installation for new systems) and runs for one year.
  • MVP Members are never charged overtime rates for emergency service calls.
  • The 15% discount applies to labour and parts on covered repairs, not to new system installations, unless otherwise specified.
  • Free service calls included with the plan must be scheduled during regular business hours (Monday through Friday, 8:00 AM to 5:00 PM). Service outside these hours may be subject to a call-out fee.
  • The membership covers one residential property. Additional properties require separate memberships.
  • If you move, the membership agreement is transferable to your new property.
  • Refunds on the MVP Membership are only available within 30 days of purchase, and only if no tune-ups or covered services have been used.
  • Filters are not included in the membership and are the responsibility of the homeowner.
  • Maintaining an active MVP Membership is required to keep any extended labour warranty coverage active.

Your membership does not replace the need for homeowner maintenance responsibilities, such as regularly changing furnace filters and keeping outdoor condenser units clear of debris.

Limitation of Liability

Brown’s Plumbing & Heating carries full Workers’ Compensation Insurance for our team and appropriate general liability insurance for our operations. We are fully licensed and insured in the province of Manitoba.

To the maximum extent permitted by Manitoba law, our total liability for any claim arising from our services will not exceed the total amount you paid for the specific work in question. We are not liable for indirect, consequential, or punitive damages, including loss of income, loss of use of your property, or damage to other systems not covered by our scope of work.

We are not responsible for damage to any part of your home or property that results from pre-existing conditions, hidden defects that could not reasonably have been identified before work began, or conditions unrelated to our work.

Existing Conditions & Pre-Existing Issues

Our technicians are thorough, but no inspection can reveal every hidden condition within walls, under floors, or inside ageing equipment. When we undertake a repair or installation, our responsibility is limited to the specific work outlined in your agreement.

We are not responsible for problems caused by pre-existing conditions such as outdated wiring, undersized ductwork, corroded pipes, inadequate insulation, or deteriorating drain lines that were not part of the agreed scope. If we discover a pre-existing issue during our work that poses a risk or affects our ability to complete the job safely, we will notify you right away and discuss your options before proceeding.

We do not guarantee that a new heating or cooling system will reach specific temperature targets if your home’s insulation, windows, doors, or ductwork are inadequate. The performance of any HVAC system depends on the overall condition of the building it serves.

Permits & Inspections

Some installations and repairs require a permit under Manitoba building codes. Where a permit is required and included in your quote, we will apply for it on your behalf. If a permit is required but not included in the original quote, we will advise you and the associated cost will be added to the total.

You agree to ensure that your property is accessible at the scheduled time for any required inspections. Any re-inspection fees resulting from the property not being accessible, or from a failed inspection due to pre-existing conditions not caused by our work, are your responsibility.

We will perform all work in accordance with current Manitoba building codes and manufacturer specifications.
